Has a country become a police state when a woman is arrested for standing in her front garden with a camera?

A woman in america was standing in her garden in america filming her friend while they were being arrested so the police didn't get too heavy. The police then arrested her for filming in her own garden! It is not against the law to use a camera in any public place. In fact sometimes it is the only way to make sure police operations are transparent. Most police officers are honest law abiding and do their job well, but are the people at the top wrong to push them in the direction of a gestapo organisation suspecting citizens rather than serving and protecting them?
